Highland Village to hold public meeting on proposed zoning amendment
From staff reports
On Tuesday, Highland Village will provide a presentation of a proposed zoning amendment for the property known as the District of Highland Village to the Planning and Zoning Commission and the public. The District of Highland Village is located at the northwest corner FM 407 and Briarhill Boulevard. The presentation is for informational purposes only as there currently is not an application pending for rezoning of this property. No action can or will be taken at the meeting.
In June 2011 the Highland Village City Council denied a zoning amendment request to allow 6.1 acres of the existing Townhome Development to be rezoned to a density of 16 multi-family residential units per acre. In October 2011, the owner of the property filed a federal lawsuit against the city based on the city's denial of the rezoning request.
During the last year, the city of Highland Village and its legal counsel have thoroughly defended against the claims made in the lawsuit. However the parties over the last eight months have worked diligently to settle their dispute. The result of those efforts to date is a development proposal that is considerably different from both the June 2011 rezoning request and the original Townhome Development plan. The new development plan is in direct concert with the city council's stated goal of seeking "superior development" for the entire site that will complement our community.
